After being rescheduled, Madonna‘s Celebration Tour hit NYC in December for three shows at Barclays Center. Two men who attended the December 13 show are now suing Madonna over a late start time, CNN reports. Michael Fellows and Jonathan Hadden say their tickets listed the show’s start time at 8:30 PM, but she didn’t come on until after 10:45 PM. When the show was over at 1 AM, they say they were “confronted with limited public transportation, limited ride-sharing, and/or increased public and private transportation costs.” It continues, “many ticketholders who attended concerts on a weeknight had to get up early to go to work and/or take care of their family responsibilities the next day.”
Madonna is accused of false advertising and negligent misrepresentation in the suit, which was filed in Brooklyn federal court and also lists Live Nation and Brooklyn Events Center, LLC (Barclays Center) as defendants. “Madonna had demonstrated flippant difficulty in ensuring a timely or complete performance, and Defendants were aware that any statement as to a start time for a show constituted, at best, optimistic speculation,” it continues.
Fellows and Hadden say that because they think other shows on the tour also started late, they are seeking class action status for the suit. “The proposed class of plaintiffs includes ticketholders for her tour throughout the US,” CNN reports, “and the plaintiffs are asking for an undisclosed amount in damages to be determined at trial.”
This isn’t the first time Madonna has been sued over her shows starting late. She’ll return to NYC this month for shows at Madison Square Garden on January 22, 23, and 29.
